A 30-year-old Ajax man is facing fraud charges after a homeowner paid tens of thousands of dollars for a warranty enrolment that police say never took place.

Durham Regional Police said in a media release that Behzad Ayon, owner of Aria Build Corporation, has been charged with fraud over $5,000 and possession of property obtained by crime over $5,000. The release was issued Oct. 15, 2026.

The charges stem from a residential construction project in Ajax. Police say the homeowner hired Aria Build Corporation in August 2024 to finish building a residence and dealt directly with the company's owner.

As part of the agreed payment schedule, the victim paid the company $56,560 so the residence could be enrolled in a Tarion warranty, according to police. The payment was deposited into a bank account associated with the company.

Police say a dispute later arose between the parties over the payment schedule and the completion of the home, and the company stopped working on the property.

The homeowner then contacted Tarion to ask what warranty protections applied to the unfinished residence. That's when they learned the home had never been enrolled and was not covered by the warranty protections they believed they had.

All charges are allegations that have not been tested in court.

Police say they are concerned there may be additional victims and are urging anyone with information, or anyone who believes they may have been defrauded in similar circumstances, to come forward.
